Law Enforcement Firearms & Hi-Cap Magazine Purchases

As you already know, Brandon Enterprises is the place to purchase all of your equipment. However, certain weapons and post-ban hi-capacity magazines can only be sold to law enforcement agencies and/or officers. While the process to make such as purchase is quick and painless, there are a few extra forms involved which must be submitted before a sale can be processed. Instructions for such a transaction are as follows:

Department Purchase of a Weapon(s):

1. Please use this classification only for weapons which are being purchased for use exclusively by the department, for the department...

2. Draft a purchase order or department letter requesting the purchase of said equipment. (Originals only! NO photocopies or FAXes) should be sent. The letter should be signed by the head of the requesting agency (i.e. Chief, Sheriff, Constable, Warden, etc.)

3. Complete a federal excise tax exemption form. Please read the form completely and made sure you comply with its contents.

4. Complete the BATF form 4473 in the department name section 1 and 5. Sign the form using your official title. (Please call to request a FAXed copy.)

5. Mail all original forms with your order. Please do not send copies or FAX your orders on firearms as this will only delay your order.
   SAMPLE LETTER FOR PURCHASE OF DEPARTMENT WEAPONS

   Brandon Enterprises Exotic Weapons & Equipment 1717 Montana Ave. El Paso, Texas 79902 Dear Sirs: Please accept this letter as a purchase order for the following weapons and/or high capacity magazines described below. (1) Smith & Wesson 5906, Blue, Fixed Sights, With High Capacity Magazines (1) Smith & Wesson, SW40F, Night Sights, With High Capacity Magazines I declare, under penalty of perjury, the weapons and/or high capacity magazines listed above are being purchased for department use by XYZ Police Department, and will be used and retained by our city. The Federal Excise Tax Form and 4473 are enclosed. Sincerely, Buford T. Justice Chief of Police

   

   Individual Purchase

   1. Send a letter ordering the weapon on department letterhead. This letter should be signed by the head of your department (Chief, Sheriff, etc.).

   2. Complete the 4473 form answering all questions 1 through 10. Please make sure that you put your correct driver's license number in section 10.

   3. Please provide any permits as required by the state in which you reside.

   4. Mail originals of all paperwork with payment. Visa, MasterCard, Discover and checks accepted. Sorry, no C.O.D.'s. Please do not send copies or FAX your orders as doing so will only delay your order.
   SAMPLE LETTER FOR INDIVIDUAL OFFICER PURCHASE
   (Please reproduce on department letterhead and have Chief or Sheriff sign.)

   Brandon Enterprises Exotic Weapons & Equipment 1717 Montana Ave. El Paso, Texas 79902 Dear Sirs: Officer John Doe is a commissioned officer of this department and Officer Doe is acquiring this weapon and/or high capacity magazine(s) for use in his official duties. Officer Doe has arrest powers. Please accept his order for the following: (1) Smith & Wesson, SW9F, Blue, Fixed Sights, With High Capacity Magazines (2) High Capacity Magazines for Duty Use Officer Doe will be responsible for the purchase price and all applicable taxes. The weapon may be shipped to the department address. Payment for the weapon and the 4473 are enclosed. Sincerely, Buford T. Justice Chief of Police

   

   Requirements for Magazine Purchases:

   All purchases of post-ban high capacity (more than 10 rounds) magazines must be made on department letterhead, signed by the head of the law enforcement agency. The letter must state under penalty of perjury that the purchaser is a police officer and the high capacity magazine will be for duty use.

   Sorry, we cannot sell POST-BAN high capacity magazines without this letter.

   Please do not FAX these letters. We are required, by law, to have the original letter.

   Brandon Enterprises Exotic Weapons & Equipment 1717 Montana Ave. El Paso, Texas 79902 Dear Sirs: I, John Doe, an officer of XYZ Police Department, declare under penalty of perjury that the weapon and/or high capacity magazine is for official duty use, and is not being acquired for personal use or for purposes of transfer or resale.    FEDERAL EXCISE TAX EXEMPTION CERTIFICATE CERTIFICATE OF ULTIMATE PURCHASER The undersigned hereby certifies that they are ____________________ and that they are authorized to execute this certificate and that the item, or items specified below are purchased from Brandon Enterprises for the exclusive use by ____________________ of ________________________ __________. It is understood that the exemption from Federal Excise Tax in the case of sales of articles under this exemption certificate to a state, territory, or its political subdivision, or District of Columbia is limited to the sale of articles purchased for its exclusive use as described, and it is agreed that if articles purchased tax free under this exemption certificate are used otherwise ,or are sold to employees or others, such fact will be reported by the undersigned or Governmental agency to Brandon Enterprises, for the article or articles covered by this certificate to secure exemption. Use of this certificate, the evidence and records required to substantiate tax free or reduced tax rate sales and purchases, must be in accordance with applicable I.R.S. regulations.
